Our litigation is handled by vibrant group attorneys whose breadth and depth of experience that comes from handling ground breaking cases in various aspects of the law such as Constitutional Petitions, Civil matters, Commercial Transactions, Land Transactions, Domestic relations and to a small extent Criminal litigation. Some of the cases we are handling and have handled include;
Davis Wesley Tusingwire Vs Attorney General; Const. Petition No. 03 of 2013. In this matter we acted for Davis in a Petition challenging the constitutionality of the composition of the High Court Anti-Corruption of Uganda established under the High Court (Anti-Corruption Division) Practice Directions.
Although the Constitutional Court dismissed the Petition, we have preferred and appeal to the Supreme Court and the appeal is yet to be heard and determined. Humphrey Nzeyi Vs BOU & Another; Const. Petition No. 44 of 2012. This is a Petition challenging the constitutionality of the actions of BOU when it unilaterally and summarily purported to liquidate National Bank of Commerce. We were able to successfully get Interim Injunctive Orders stopping the Central Bank from continuing the process of liquidating NBC. The head Petition is yet to be heard and determined.
Hon. Abudu Katuntu & Another Vs MTN & 7 Others HCT-00-CC-CS-0248-2012. In this matter we act for the Plaintiffs (Hon. Katuntu & Another) seeking declarations among others that, Mobile Money business currently being carried out by Telecos is Financial Institution business and that the business in its current form is unregulated. The matter is pending hearing and determination.
Sedrach Mwijakubi & Othrs Vs British American Tobacco (U) Ltd (BAT) HCT-00-CC-CS-286-2005. This was a case that involved tobacco farmers from Masindi and Hioma districts who had been contracted by BAT to grow tobacco for the 2004 season and it was had also been agreed that BAT would purchase all the tobacco for that season from the farmers upon harvest. However, BAT didn’t purchase all the tobacco as had been agreed. We successfully pursued the case in Court and obtained judgment compelling BAT to compensate the farmers’ money in the excess of 4 billion shillings.
Wananchi Group (U) Ltd Vs The New Vision Printing Company Ltd. In this matter, the our client (the Plaintiff) sued the Defendant for committing acts against competition when it entered into an exclusivity Agreement with a Pay per view Television for the content of one of its free to Air Television products. The mater is still pending in Court.
Ham Enterprises & Ors Vs. Diamond Trust Bank (U) Ltd & Ors. We represent Ham Enterprises and 2 Others challenging the legality of the credit facilities that were advanced by DTB Kenya and Uganda to Ham Enterprises in so far as the said lending was not authorized by the Central banks of Kenya and Uganda.
